These terms apply when you buy from ukunderground.com ("the store", "we", "us"). They do not affect your statutory rights as a consumer. Please read them together with our Returns, Cancellation & Refunds policy and Privacy Policy.
1. What we sell
We sell digital content (music downloads in MP3/WAV formats and software) and physical items (such as CDs and vinyl). Digital purchases are delivered to your on-site account library ("My Library"); physical items are dispatched to the delivery address you give at checkout.
2. Ordering and when the contract is formed
Placing an order is an offer to buy. Your payment is taken by PayPal when you approve it at checkout; the contract between us is formed when we accept your order by sending the order confirmation email. The confirmation email is your durable record of the order and includes these key terms. If we cannot accept an order (for example a pricing error or stock problem) we will refund the payment in full.
3. Prices, currency and VAT
All prices are shown inclusive of VAT where applicable. You can shop in GBP, EUR or USD; the price book for each currency is fixed rather than converted live, and the currency you see at checkout is the currency you pay in. For EU consumers, VAT is accounted for at your member state's rate under the EU One Stop Shop scheme where applicable. Delivery charges for physical items, if any, are shown at checkout before payment.
4. Digital content — delivery and your cancellation right
Digital purchases normally appear in My Library immediately after payment. As a consumer you normally have 14 days to cancel a distance purchase. For digital content, the law works like this:
At checkout you are asked to expressly consent to immediate delivery of your digital content, and to acknowledge that once delivery has begun you lose the 14-day right to cancel. We only make the downloads available once you have given that consent. If you do not give it, digital delivery is delayed until the 14-day cancellation period has expired.
This waiver applies only to the digital items in an order — it never affects your cancellation rights for physical items, and it never affects your rights if the content turns out to be faulty (see section 6).
5. Physical items — delivery and your 14-day cancellation right
Physical items are dispatched to the address given at checkout; estimated dispatch times are shown on the product page or at checkout. You have the right to cancel an order for physical items, without giving any reason, within 14 days of the day the goods are delivered (to you or to someone you nominate). 6. Faulty goods and faulty digital content — your statutory rights
Under the Consumer Rights Act 2015 everything we supply must be of satisfactory quality, fit for purpose and as described. For physical goods you have a short-term right to reject faulty goods within 30 days for a full refund, and after that the right to a repair or replacement, and then a price reduction or final rejection. For digital content you are entitled to a repair or replacement of faulty content, and if that fails, a price reduction or refund; if faulty digital content damages your device we may also be liable to repair the damage or compensate you. If a download is corrupt or won't unlock, contact support@ukunderground.com and we will fix it or refund you.
7. Licence for digital content
Digital music and software are licensed to you for personal, non-commercial use. You may download and keep copies for your own listening/use on your own devices. You may not resell, redistribute, upload, publicly perform or make the files available to others. All copyrights remain with the rights holders. DJ/broadcast/sync use requires the appropriate licences from the relevant collecting societies or from us in writing.
8. Your account
Purchases are linked to the email you give at checkout, and an account is created for you if you don't have one. Keep your password confidential; you are responsible for activity on your account. You can view your orders, re-download purchases, export your data and delete your account from the account pages at any time.
9. Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law — including your statutory consumer rights. Otherwise, our total liability in connection with an order is limited to the price paid for that order, and we are not liable for losses that were not foreseeable to both of us when the contract was made.
10. Complaints, law and courts
Complaints: email support@ukunderground.com — we aim to acknowledge within 2 working days. These terms are governed by the law of England and Wales, and you can bring proceedings in the courts of England and Wales. If you live elsewhere in the UK or in the EU, you keep the benefit of any mandatory consumer protections, and may bring proceedings in your local courts, under the law of the country where you live.
